HB 1003 Summary

• Amends Arkansas Code 5-54-125(d) to add a new felony provision for fleeing in a vehicle while exceeding 90 miles per hour when pursued by law enforcement

• Establishes that fleeing by vehicle remains a Class A misdemeanor with a minimum of two days jail time under standard circumstances

• Creates a Class D felony for fleeing by vehicle if the person either operates the vehicle in a manner creating substantial danger of death or serious injury, OR exceeds 90 MPH while being pursued by law enforcement

• Elevates the offense to a Class C felony if serious physical injury to any person occurs as a direct result of the fleeing incident
