AR HB1013

Adds new section 17-25-317 to Arkansas Code allowing the Contractors Licensing Board to suspend or revoke a contractor's license if found to knowingly employ workers without legal authorization to work in the United States, either directly or through subcontractors.

Defines "worker without legal authorization to work in the United States" as an individual who cannot present valid documentation of identity and work authorization as required by Federal Form I-9 as it existed on January 1, 2011.

Establishes use of the federal E-verify system as an affirmative defense; contractors using E-verify to verify the legal status of all employees cannot be found to have knowingly employed unauthorized workers.

Shields contractors from liability for unauthorized workers employed by subcontractors if a written agreement requires the subcontractor to verify worker authorization through the E-verify system.

Requires the Contractors Licensing Board to promulgate rules necessary to implement the section.
