Federal employees not designated as Arkansas peace officers must obtain written permission from the county sheriff before making arrests, searches, or seizures in the state, except in specified circumstances.

Exceptions to the permission requirement include arrests on federal enclaves with ceded jurisdiction, witnessing crimes requiring immediate arrest, customs/immigration law enforcement, arrests of sheriff's office employees or elected officials, and cases where the subject has close connections to the sheriff.

Arrests involving elected county or state officers require written permission from the Arkansas Attorney General unless delay would cause serious harm or flight risk; requests must include the subject's name, probable cause statement, assets to be seized, date/time, and location.

Federal employees violating these requirements shall be prosecuted by county prosecuting attorneys as private citizens, and victims may receive crime victim benefits from the Crime Victims Reparations Revolving Fund.

The state declares under the Tenth Amendment that any federal law granting federal employees county sheriff authority in Arkansas is not recognized and is invalid in the state.
