Allows county-owned but non-operated health care facilities to exclude employees from the Arkansas Public Employees' Retirement System by a two-thirds vote of the governing body, with certification to the Board of Trustees required within one year of the effective date

Applies the same exclusion option to facilities where county operation is transferred after the effective date, with certification required within one year of the transfer

Applies the same exclusion option to facilities constructed or acquired by a county after the effective date but not operated by the county, with certification required within one year of construction or acquisition

Declares an emergency clause, citing confusion about the applicability of current law and resulting litigation, and stating that loss of these facilities would harm residents who depend on them for essential services
