AR HB1611

Amends Arkansas Code § 18-60-108 to establish that owners, lessees, or occupants of land owe no duty of care to trespassers and are not liable for injuries to trespassers.

Liability only arises after the property owner becomes aware of a trespasser's presence on the premises, and then only for willful or wanton misconduct by the owner, lessee, or occupant.

Preserves the doctrine of attractive nuisance but prohibits its use as a basis for liability on agricultural land for injuries to trespassers over 18 years of age.

Defines "trespasser" as a person who enters another's property without permission and without express or implied invitation.
