AR HB1765

Adds Arkansas Code section 20-77-314 establishing the Department of Human Services' entitlement to reimbursement for medical assistance payments from third-party settlements, judgments, awards, or other third-party payments that compensate for those medical costs.

Allows the department to receive the full amount of its medical assistance claim unless the third-party payment portion compensating for medical costs is less than the full claim amount.

Grants the department's medical assistance claim priority over any claim by a medical care provider.

Provides that the department's rights under this section cannot be eliminated by any rights possessed, asserted, or not asserted by a medical assistance recipient or other person.
