AR HB1866

Amends Arkansas Code § 5-13-205 to add impeding or preventing respiration or blood circulation by applying pressure to the throat/neck or blocking the nose/mouth as assault in the first degree, classified as a Class A misdemeanor.

Creates a new offense of smothering or strangulation in the first degree under Arkansas Code § 5-13-212, defined as purposely and with extreme indifference to human life impeding or preventing respiration or blood circulation, classified as a Class C felony.

Establishes smothering or strangulation in the second degree as purposely impeding or preventing respiration or blood circulation by applying pressure to the throat/neck or blocking the nose/mouth, classified as a Class A misdemeanor.

Provides an affirmative defense to both assault in the first degree and smothering or strangulation charges if the victim consented to the impeding or prevention of respiration or blood circulation.
