AR HB2136

Requires all public swimming pools to be maintained under the supervision or direction of a certified pool operator who is either on staff or on call, excluding private pools at single family residences.

Defines "certified pool operator" as a person certified by the Department of Health for pool sanitation, safety, maintenance, equipment upkeep, and record keeping.

Department of Health may certify pool operators who complete one or more approved courses including National Swimming Pool Foundation, National Spa and Pool Institute, or National Recreation and Park Association certifications, with renewal required at least every five years.

Allows pool service technicians holding certified operator certifications to contract for pool maintenance under supervision or direction of a certified pool operator, with technician names filed with the Department of Health.

Establishes enforcement beginning January 1 of the year after the subchapter becomes effective, with violations constituting a Class B misdemeanor, with each day of violation treated as a separate offense.
