AR HB2146

Creates a new crime under Arkansas Code 5-52-109 making it a Class A misdemeanor for a circuit court or district court judge to knowingly receive and disburse funds to any person or entity not authorized by law to receive them.

Increases the penalty to a Class D felony for any second or subsequent violation of the illegal disbursement provision.

Requires sentencing courts to order judges convicted of illegal disbursement to make full restitution of all illegally disbursed funds in addition to any fine imposed.

Adds Arkansas Code 16-10-139 prohibiting judges from making payments for services rendered to public defenders, assistant public defenders, prosecuting attorneys, or deputy prosecuting attorneys that result from those officials' performance of their official duties.
