Repeals Arkansas Code §§ 20-8-111 and 20-8-112 which allowed the Governor to transfer the Developmental Disabilities Planning Council to other state agencies.

Creates a new Developmental Disabilities Council as a permanent state entity to coordinate, monitor, plan, and evaluate services for individuals with developmental disabilities.

Requires council membership to consist of at least 60% individuals with developmental disabilities, parents or guardians of affected children, or relatives of affected adults who cannot self-advocate, with members serving four-year terms (initial appointees serve staggered 2, 3, or 4-year terms).

Establishes council duties including planning state resource coordination, advising the Governor and General Assembly, promoting service provision, monitoring programs, developing state plans, and administering federal Developmental Disabilities Assistance and Bill of Rights Act requirements.

Authorizes the council to hire an Executive Director and staff, prepare annual budgets, and report annually to the Governor and relevant House and Senate committees on developmental disabilities programs.
