Clarifies that clerical or recordkeeping errors may be subject to recoupment but are not subject to criminal penalties without proof of intent to commit fraud

Requires recoupment of overpayments to be based on actual amounts unless the overpayment projection is part of a settlement agreement

Prohibits audit charges or assessments from being based on recouped amounts, except when explicitly stated in a contract and employee commissions are not tied to recoupments

Establishes that audits cannot exceed 24 months from claim submission, limits non-targeted audits to 25 randomly selected prescriptions, and restricts audits to twice per calendar year

Exempts fraud investigations, Medicaid fraud cases, and insurance fraud investigations from the pharmacy audit bill of rights procedures
