Senate Bill 760 - Towing and Storage Consumer Protection

• Limits possessory liens held by towing and storage companies to the vehicle only, removing liens on vehicle contents, trailers, and trailer contents unless the owner fails to claim property within 45 days.

• Prohibits towing companies from charging storage fees for any day their business office is not open for at least 8 consecutive hours.

• Establishes that vehicle contents, attached trailers, and trailer contents must be released without charge to the vehicle owner or authorized representative, with limited exceptions for unclaimed property after 45 days.

• Clarifies that lienholders who reclaim vehicles are accountable to owners for vehicle contents and attached trailers in the same manner as standard vehicle repossession cases.

• Requires notice to vehicle owners include information that they may recover vehicle contents without charge by providing proof of ownership or authorization within 45 days.
