Senate Bill 845 - Abortion Patients' Enhanced Safety Act

• Requires abortion clinics (facilities performing 5+ first trimester abortions monthly or any second/third trimester abortions) to meet licensing and regulatory standards for ambulatory surgery centers under Arkansas law.

• Makes operating an abortion clinic without a valid ambulatory surgery center license a Class A misdemeanor, with fines up to $1,000 per day of violation.

• Mandates Department of Health inspections of non-surgical and chemical abortion facilities at least once every 6 months, with written reports made available to the public (excluding patient records and employee personal information).

• Establishes that the subchapter does not create or recognize a right to abortion and is not intended to legalize abortions currently unlawful in Arkansas.

• Declares an emergency and sets the effective date as July 1, 2011, based on findings that current abortion facilities do not meet appropriate surgical standards and present health risks to women.
