Circuit courts in Arkansas gain jurisdiction to grant injunctive relief to Medicaid providers against enforcement actions taken by any division of the Department of Human Services while administrative appeals are pending.

Injunctive relief may be granted upon a showing that the absence of such relief could cause irreparable harm to the Medicaid provider.

The bill declares an emergency based on findings that Medicaid providers have been denied due process and access to justice through injunctive relief, and that this denial adversely affects delivery of critical health care services to needy citizens.

The act becomes effective upon gubernatorial approval, at the expiration of the Governor's veto period, or upon veto override by the legislature.
