Reduces the consent threshold for constructing motor vehicle racing facilities from 75% to 38% of property owners and registered voters within 3 miles of the proposed facility.

Eliminates the requirement for an annual permit from the Arkansas Department of Environmental Quality; consent is now required only for initial construction approval.

Removes the public hearing requirement, permit application process, and department review of facility specifications including noise levels and traffic impacts.

Repeals Arkansas Code § 8-10-303 entirely, which previously governed permit issuance, public hearings, and department authority to approve or deny racing facility permits.

Maintains exemptions for motor vehicle racing facilities located in counties with 80,000-90,000 population that are south of a navigable waterway or more than 2 miles from schools, interstate highways, or churches.
