AR HB1042

Prohibits private property acquisition by eminent domain for private commercial enterprises, economic development in the private sector, or private use, except for utilities, electric cooperatives, pipeline companies, railroads, and common carriers.

Prevents transfer of property from one owner to another based solely on the grounds that the public will benefit from a more profitable use of the property.

Allows property owners to request judicial determination of whether an acquisition is for legitimate public use when eminent domain is attempted.

Exempts acquisitions by the State Highway Commission, Arkansas State Highway and Transportation Department, counties, and municipalities for roadway, street, or right-of-way construction and maintenance from these restrictions.

Declares this legislation supplemental to all other existing laws restricting real property acquisition through eminent domain.
