AR HB1498

Amends the definition of "qualified psychiatrist" to include those currently participating in a post-residency forensic psychiatry fellowship or those who completed an approved forensic certification course, in addition to those with American Board of Psychiatry and Neurology credentials

Amends the definition of "qualified psychologist" to include those currently participating in a formal postdoctoral forensic psychology fellowship or those who completed an approved forensic certification course, alongside those with American Board of Professional Psychology diplomas

Adds new definitions for "frivolous" (clearly lacking any basis in fact or law) and "repetitive" (filed within 6 months of a previously denied application under § 5-2-316 without demonstrating material change in circumstances)

Authorizes courts to dismiss applications for conditional release modification on their own motion or a party's motion if the court determines the application is frivolous or repetitive

Applies the same qualifications for psychiatrists and psychologists to examinations and observations regarding insanity defense proceedings under § 16-86-103
