AR HB1750

Amends Arkansas Code § 27-51-310 to expand "authorized vehicle" definition to include emergency response vehicles, law enforcement vehicles, Arkansas State Highway and Transportation Department vehicles and contractor vehicles, utility company vehicles, and towing operation vehicles that display flashing, revolving, or rotating blue, red, amber, white, or green lights.

Requires approaching drivers to move to the farthest possible lane from an authorized stopped vehicle and remain in that lane until passing; if lane change is unsafe or impossible, drivers must reduce speed and maintain caution through the area.

Establishes misdemeanor penalties of $35 to $500 fine, up to 90 days county jail confinement, or both for violations of the move-over requirement.

Allows courts to impose additional penalties including up to 7 days community service and driver's license suspension of 90 days to 6 months.

Creates rebuttable presumption that a registered vehicle owner was the driver at the time of a violation if the vehicle is proven to have been driven in violation of this section.
