AR HB1793

Creates the Scrap Metal Recycler Oversight Commission with 7 voting members appointed by the Governor and 1 non-voting ex officio member (the Department of Environmental Quality director or designee).

Establishes commission membership composition including 2 scrap metal recycler owners, 1 public utility/railroad representative, 1 agricultural representative, 1 city/town law enforcement officer, 1 county sheriff, and 1 business community representative.

Grants the commission powers to license scrap metal recyclers, conduct background investigations and facility inspections, adopt and enforce regulations, issue subpoenas, assess licensing fees, and report violations to law enforcement and prosecutors.

Authorizes the commission to adopt rules regulating scrap metal recycler conduct including record-keeping requirements, payment types, licensure processes, administrative penalties, and enforcement procedures under the Arkansas Administrative Procedure Act.

Allows appeals of commission administrative orders to Pulaski County Circuit Court and permits removal of voting members by majority vote for felony conviction, failing to attend 3 consecutive meetings, or no longer meeting appointment qualifications.
