AR HB1867

Requires public servants to forfeit their office, position, or employment upon pleading guilty or being found guilty of felony offenses relating to their position, misdemeanor offenses involving fraud, dishonesty, bribery, forgery, or corruption, or theft of property when the victim is their governmental body.

Disqualifies individuals convicted of covered offenses from holding any office, position, or employment with a governmental body.

Establishes that circuit courts must order convicted public servants to pay a penalty determined by considering the length and severity of the offense, money cost to the governmental body, salary during the offense period, breach of public trust, and other relevant factors.

Creates separate procedures for public officials (General Assembly members or state constitutional officers) who may be removed under Article 5 of the Arkansas Constitution and ordered to pay penalties for felony offenses, theft, abuse of office, or witness tampering.

Permits public officials or public servants to hold public office after removal if the identified offense is expunged and permitted under applicable law, and preserves taxpayers' rights to bring civil actions under Arkansas Constitution Article 16, § 13.
