Defines "office-based surgery" as surgery performed by a physician in a non-hospital medical office using general or intravenous anesthetics that does not require hospitalization in the physician's opinion.

Requires the Arkansas State Medical Board to adopt rules regulating office-based surgery within 18 months of the act's effective date.

Amends the definition of "outpatient surgery center" to exclude physician-owned medical offices that do not bill facility fees to third-party payors.

Allows physician-owned medical offices to voluntarily apply for licensure by the State Board of Health as an outpatient surgery center.

Excludes dental offices with moderate or general/deep sedation permits from the outpatient surgery center definition.
