AR HB2145

Adds new Subchapter 5 to Arkansas Code Title 16, Chapter 120, establishing charitable immunity protections for churches or other places of worship used as polling sites.

Churches and places of worship are granted tort immunity during the time they are used as polling sites, including protection from vicarious liability for negligence of other persons on the property.

Churches are not liable for personal injury, death, or property damage occurring on their property during polling site use, except when the church is insured (liability limited to policy coverage) or acts in bad faith, with gross negligence, recklessly, or intentionally.

The subchapter is supplemental to and does not replace any other tort or charitable immunity protections churches or places of worship may have under existing law.
