SB 1010 Summary

• Creates new offense of unlawful sale of bedding and establishes labeling requirements for all bedding sold in Arkansas, with white labels for "ALL NEW MATERIAL" and yellow labels for "SECONDHAND MATERIALS"

• Requires bedding labels to include filling material contents and percentages, manufacturer/renovator registry numbers, certification statements, and specific warning language; labels must be permanently affixed and cannot be removed except by consumer

• Prohibits secondhand material bedding unless sanitized or germicidally treated by department-approved methods, with additional labeling requirements including sanitization date, method, and provider information

• Makes false labeling or knowingly selling secondhand bedding as new material a Class A misdemeanor, with each bedding product constituting a separate violation; authorizes Arkansas Department of Health to inspect premises, embargo violative products, and deny or revoke permits

• Grants Arkansas Department of Health authority to adopt implementing rules covering label specifications, permit procedures, sanitization standards, and incorporation of recognized industry testing standards
