Amends Arkansas Code § 11-10-210(f) to exclude personal care services performed for certified ElderChoices Providers from the definition of employment, except when the provider is a state or local government entity, federally recognized Indian tribe, or nonprofit organization.

Makes the exclusion retroactive to January 1, 2010.

Declares an emergency based on findings that ElderChoices clients are vulnerable citizens, personal care caregivers provide essential services to help clients remain healthy and avoid institutionalization, and recent Department of Workforce Services decisions regarding caregiver employment status have jeopardized these workers.

Establishes immediate effective date upon gubernatorial approval, expiration of the Governor's veto period without action, or veto override by the legislature.
