Legislative Council must present draft legislation to the Speaker of the House and President Pro Tempore of the Senate by January 1 preceding each regular session recommending which expiring rules should receive continued legislative authority.

Draft legislation shall use a standardized form granting continued authority to all rules expiring July 1 of a given year under § 25-15-204, except for those specifically listed for exclusion.

Continued legislative authority for rules may be granted with either no expiration date or an expiration on a specific future date.

Legislative authority to promulgate rules expires on July 1 of the next odd-numbered year following final rule filing unless the General Assembly grants continued authority, with exceptions for federally mandated rules or rules with specific constitutional authority.

Granting continued legislative authority for a rule does not constitute legislative approval of the rule itself.
