• Declares void and unenforceable any provision in construction contracts that requires one party to indemnify another for liability arising from death, bodily injury, or property damage caused by the indemnitee's negligence or fault.

• Prohibits circumvention attempts through provisions making contracts subject to another state's laws or requiring disputes to be resolved outside Arkansas.

• Permits indemnification only when limited to the indemnitee's own negligence and fault, and allows agreements requiring liability insurance or naming parties as additional insureds.

• Applies restrictions equally to both private construction contracts and public construction contracts entered after July 31, 2007.

• Allows indemnification provisions that do not exceed the degree or percentage of negligence or fault attributable to the party providing the indemnification.
