State agencies must file proposed rules with the Administrative Rules and Regulations Subcommittee of the Legislative Council before promulgating rules that license new healthcare professions or expand the scope of existing licensed healthcare professions.

The subcommittee shall conduct a study of the necessity of any proposed rule affecting healthcare provider licensure or scope of practice.

State agencies are prohibited from promulgating healthcare provider licensure or scope expansion rules until the subcommittee completes its necessity study.
