Allows school districts on the state consolidation list to annually request a waiver from the 350-student average daily membership requirement by submitting a petition within 30 days of list publication.

State Board of Education must decide on waiver petitions within 45 days and grant waivers if districts demonstrate they are not in academic, fiscal, or facilities distress; are not on probationary status; have adequate facilities; and it is in students' best interest to remain open based on transportation distance.

Waived school districts remain on the consolidation list annually and the State Board may revoke waivers at any time if conditions change, particularly if the district enters academic, fiscal, or facilities distress.

Modifies the automatic consolidation requirement by allowing districts to avoid immediate administrative consolidation by July 1 if they have received a waiver under this new section.

Declares an emergency effective upon Governor approval, the expiration of the Governor's veto period, or veto override to ensure small school districts are not consolidated immediately.
