HB1421 Summary

• Requires abortion providers to obtain admitting privileges at a licensed hospital within 30 miles of the abortion clinic where they perform procedures

• A physician with admitting privileges must remain on the premises on any day abortions are performed to facilitate emergency transfers and remain until patients are stable and ready to leave recovery

• Applies to abortion clinics defined as healthcare facilities (other than hospitals) performing five or more first-trimester abortions monthly or any second or third-trimester abortions

• Establishes penalties including Class A misdemeanor charges for violations, civil malpractice liability, and professional disciplinary action under the Arkansas Medical Practices Act

• Takes effect January 1, 2016; does not create a right to abortion and does not require hospitals to ask about or consider physicians' abortion practices in credentialing decisions
