Pharmacists must make a professional determination based on a pharmacist-patient relationship to verify legitimate medical and pharmaceutical need before dispensing products containing ephedrine, pseudoephedrine, or phenylpropanolamine without a valid prescription.

Pharmacists may base their determination on prior medication-filling history, patient screening, and other tools that provide professional reassurance of legitimate medical need.

The Arkansas State Board of Pharmacy may adopt rules regarding pharmacist determinations, review those determinations, and take appropriate disciplinary action as required.

Pharmacists are not prohibited from dispensing these products to persons who have not frequently utilized the pharmacist's services or have not established a prior pharmacist-patient relationship.

Persons under 18 years of age may possess and sell products containing these substances when acting as an agent of their employer within the scope of employment.
