HB1562 Summary

• Expands the definition of sexual misconduct by massage therapists to explicitly include sexual activity with client consent or at client request

• Establishes criminal penalties of up to 6 months imprisonment and/or fines up to $1,500 for violations, with possible emergency suspension or revocation of licensure

• Replaces references to "Arkansas State Board of Massage Therapy" with "Department of Health" throughout licensing and enforcement provisions

• Disqualifies applicants from massage therapy licensure who have been convicted of felonies, Class A misdemeanors, or offenses involving sexual misconduct, human trafficking, or violent crimes

• Allows massage therapists on active military duty to renew expired licenses without paying late fees by submitting military documentation and the renewal fee
