AR HB1613

Creates a driver monitoring program administered by the Office of Driver Services to monitor driving records of individuals at the request of insurers and provide monthly reports indicating whether traffic violations or accidents occurred during the previous month.

Establishes written agreements between the Office of Driver Services and insurers (insurance companies licensed to do business in Arkansas or their authorized agents) to monitor driver records of policy holders for re-underwriting purposes.

Sets monthly fees of 12 to 19 cents per insured monitored, with 1 cent deposited to the State Highway and Transportation Department Fund and remaining revenues deposited to the State Central Services Fund for the Revenue Division of the Department of Finance and Administration.

Exempts driver monitoring reports from the notice requirement that normally requires drivers to be notified when their records are reported to third parties.

Requires insurers to purchase a full driving record when a driver monitoring report indicates a violation has been posted during the previous month.

Takes effect January 1, 2016.
