HB1649 - The Van Accessible Parking Act

• Creates a "van accessible parking decal" designation for vehicles transporting persons with limited or no use of their legs, or those using wheelchairs, scooters, or similar mobility devices, and establishes authorization for exclusive use of van accessible parking spaces.

• Increases minimum fines for parking violations in disability-designated spaces from $100 to $250 for first offenses and from $250 to $500 for second and subsequent offenses, with fines reducible to $100 upon completion of an approved disability parking compliance awareness class.

• Requires vehicles displaying van accessible parking decals to be actively transporting the authorized person with a disability, prohibiting use for other purposes.

• Modifies fine distribution to allocate 50% to the Governor's Commission on People with Disabilities (for scholarships and small business compliance grants) and 50% to local city general funds for Americans with Disabilities Act compliance expenses.

• Becomes effective July 1, 2016.
