The Arkansas Department of Environmental Quality shall prepare a list of each category of permit it issues and petition the Pollution Control and Ecology Commission to determine which permits require enhanced notice.

Enhanced notice is required for new permits including Concentrated Animal Feeding Operations, hazardous waste facilities, major Title V Clean Air Act permits, major NPDES permits, confined animal feeding operations, solid waste facilities, and surface mines.

Enhanced notice is not required for permit renewals, modifications without new environmental impact, or permits with minimal impact including one-time land applications, carwash permits, and stormwater general permits.

Facilities subject to enhanced notice must provide certified mail notice to adjacent property owners, county judges, mayors within 10 miles, school superintendents, and public water treatment facility contractors, retaining receipts for the permit's active life.

Facilities must post a sign at least 2 feet by 3 feet on public roads near the facility entrance before submitting applications and certify compliance with notification requirements within 30 days of submission to the department.
