AR HB1820

Amends Arkansas Code § 16-105-402 to redefine "owner" to include any person with vested ownership and title of property, including local, city, state, or federal governmental entities.

Expands the list of property types that can be declared a common nuisance to include stores, shops, warehouses, dwelling houses, buildings, boats, airplanes, abandoned governmental or municipal property, and any other property or structure.

Changes the standard for declaring a common nuisance from requiring a court determination to automatically treating property used for unlawfully selling, storing, keeping, manufacturing, using, or donating controlled substances as detrimental to public morals and a common nuisance.

Requires courts to order that common nuisances be enjoined, abated, and prevented.

Allows recovery of costs of enjoinment, abatement, prevention, and damages against any person or entity found to be the owner of the common nuisance property.
