Property owners adjoining state highways may install, use, and maintain sprinkler systems on the highway right-of-way upon receiving a permit from the Arkansas State Highway and Transportation Department.

Property owners assume all risk when mowing grass or maintaining sprinkler systems on the right-of-way and waive claims for damages against the Department or political subdivisions for loss of life, injury, or property damage.

Owners must mow and maintain sprinkler systems in a manner that does not obstruct or pose danger to motorists lawfully using the highway.

Property owners are liable for any loss, injury, or damage to motorists or others caused by their actions or negligence in connection with mowing or sprinkler system maintenance on the highway right-of-way.

The bill allows the existing mowing privilege for adjoining landowners to be expanded to include sprinkler system installation, use, and maintenance on state highway rights-of-way.
