County judges may notify general contractors in writing within 30 days of project work order issuance to request purchase of excess or unused bridge steel and materials at salvage value price.

General contractors retain the right to keep surplus bridge material for their own use and have no obligation to notify county judges about bridge projects undertaken in their county.

Counties have a right of first refusal to purchase surplus bridge material at salvage value price if the general contractor elects to sell for salvage.

Surplus bridge material purchases are sold "as is" and counties must hire an engineer to inspect materials for suitability; general contractors have no responsibility to inspect or warrant the material's condition.

Counties must retrieve and transport purchased materials within 30 days of the contractor's election to sell at salvage value, unless parties agree otherwise; no cause of action in negligence or otherwise is available against the contractor.
