Creates the "Fair and Open Competition in Governmental Construction Act" to prohibit public agencies from including union-related requirements or discriminatory terms in construction contracts, grants, tax abatements, and tax credits

Prohibits public agencies and construction managers from requiring, prohibiting, encouraging, or discouraging bidders and contractors from entering into collective bargaining agreements relating to construction projects

Prohibits grants, tax abatements, and tax credits conditioned on including union-related contract terms in construction, improvement, maintenance, or renovation projects

Allows exemptions from these requirements only when the public agency head finds after public notice and hearing that special circumstances are necessary to avert an imminent threat to public health or safety, excluding labor disputes

Preserves the right of employers and parties to voluntarily enter into collective bargaining agreements and protects activities covered under the National Labor Relations Act
