Declares void and unenforceable any clause in construction agreements or contracts (entered after July 31, 2007) requiring one party to indemnify, defend, or hold harmless another party against damages from the indemnitee's sole negligence for death, bodily injury, or property damage.

Prohibits enforcement of clauses requiring litigation, arbitration, or alternative dispute resolution proceedings to be conducted in another state.

Applies the same unenforceable provisions rules to public construction agreements and contracts under Arkansas Code § 22-9-214.

Exempts from these restrictions any construction agreement or contract providing work or services to an operator directly related to exploration, drilling, production, processing, gathering, or movement of oil or gas on sites where such operations have occurred, are occurring, or will occur.

Adds definitions for "Gas," "Oil," and "Operator" related to petroleum and hydrocarbon production and exploration activities.
