AR SB828

Adds Subchapter 9 to Arkansas Code Title 23, Chapter 61, creating the "Arkansas Health Insurance Innovation Act of 2015" to enable exploration of innovative approaches to health insurance coverage and healthcare access, affordability, and quality.

Authorizes the Governor to submit and apply for federal waivers under 42 U.S.C. §§ 1315, 1396n, and 18052; 31 C.F.R. Subtitle A, Part 33; and 45 C.F.R. Subtitle A, Part 155, Subpart N, as well as any other waivers necessary to effectuate the act's purposes.

Grants the Insurance Commissioner, Department of Finance and Administration, Department of Human Services, and Arkansas Health Insurance Marketplace authority to promulgate rules implementing the subchapter and federal waivers, with the Governor determining rule distribution in joint waiver applications.

Exempts Arkansas Health Insurance Marketplace rules from the Arkansas Administrative Procedure Act and requires them to follow § 23-61-803 procedures; establishes that conflicting rules give priority to those approved by the Centers for Medicare and Medicaid Services or other federal agencies.

Declares an emergency effective immediately upon Governor approval, signing deadline expiration, or veto override, citing federal timeframes and deadlines for waiver submissions.
