Authorizes the Director of the Division of Medical Services to determine and certify that a Medicaid provider is out of business and that overpayments cannot be collected under state law and procedures.

Director may make determinations based on any facts and circumstances deemed relevant and material, or conclusively presume a provider out of business upon suspension, expiration, surrender, or revocation of required licenses or certifications.

For entity-structured providers, director may presume closure as of the date of entity dissolution, occurrence of an event triggering dissolution, or forfeiture/revocation of the entity's charter or business authority by the Secretary of State.

Determinations do not abrogate or limit a provider's debt obligation, do not serve as a defense to recoupment of Medicaid payments, and may not be used as basis for adverse action against a provider.

Department of Human Services may promulgate rules to administer this section.
