AR SB855

Establishes that public right to use an unpaved road easement is abandoned if access is denied by a gate that is closed and locked continuously for one year, except for brief access by the owner or those with express permission.

Bars any legal action to assert the public's right to use an unpaved road after the easement has been abandoned under these conditions.

Exempts from these provisions: roads maintained by the State of Arkansas, roads maintained or accepted for perpetual maintenance by a county, roads maintained by an improvement district, roads within city limits of first or second class cities, and claims of persons using the road as access to lands they own or lease.

Modifies Arkansas Code § 18-61-102 to clarify that entry requirements do not apply to unpaved road easement abandonment circumstances.
