• Establishes a property right in an individual's name, voice, signature, photograph, and likeness that is freely transferable, assignable, licensable, and inheritable without expiration upon death.

• Requires successors in interest to register publicity rights claims with the Secretary of State on a form verified under oath with a filing fee not to exceed $25.00 to recover damages for unauthorized commercial use.

• Provides exclusive remedies allowing property right holders to recover actual damages and disgorgement of profits from unauthorized commercial use, with courts able to issue injunctions to prevent violations.

• Exempts news, sports broadcasts, political campaigns, entertainment works, educational uses by institutions of higher education, and photography portfolios from the prohibition on commercial use without consent.

• Applies protection rights for 50 years after an individual's death and only to individuals maintaining a domicile or residence in Arkansas as of the effective date.
