AR HB1039

Amends Arkansas Code § 5-73-107 to add a defense for possession of a defaced firearm if the firearm was manufactured prior to January 1, 1968.

Establishes possession of a defaced firearm as a Class D felony, with an exception for Class A misdemeanor if the serial number or identification mark is merely covered or obstructed but still retrievable.

Maintains existing defense that a person reported the possession to police or other governmental agency prior to arrest or issuance of an arrest warrant or summons.

Defines the offense as knowingly possessing a firearm with a manufacturer's serial number or other identification mark required by law that has been removed, defaced, marred, altered, or destroyed.
