AR HB1042

Prohibits state-supported institutions of higher education from enacting sanctuary policies that limit cooperation with federal immigration authorities or restrict communication about immigration status on campus.

Defines sanctuary policy to include six specific prohibited actions: blocking communication with federal agencies on immigration status, granting unlawful presence to illegal immigrants, violating 8 U.S.C. § 1373, restricting cooperation with ICE detainers, requiring ICE to obtain warrants, or preventing law enforcement from asking about citizenship or immigration status.

Requires institutions to certify annually to the Department of Higher Education that they do not maintain a sanctuary policy, with the department submitting annual reports to the Legislative Council.

Institutions that fail to make the annual certification become ineligible to accept state aid from the Higher Education Grants Fund Account on behalf of students.

Mandates that boards of trustees provide law enforcement officers and campus security officers with printed copies of the law and written notice of their duty to cooperate with state and federal immigration enforcement.
