Nonresidential business consumers classified in sectors 31-33 of the North American Industry Classification System (as of January 1, 2013) or state-supported institutions of higher education may opt out of utility-sponsored energy conservation programs by notifying the Arkansas Public Service Commission by September 15 of any year.

Consumers seeking to opt out must return to the applicable public utility any amounts received from the utility calculated from the installation date of the last energy conservation program or measure, including interest and directly attributable rate effects.

Returned amounts must cover payments the utility made for installation of energy conservation programs and measures, or for financing and rebates or incentives that enabled such installations.

Notification may be provided by mail or electronic mail to the commission.
