AR HB1431

Adds Arkansas Code 12-9-118 requiring chief executive officers to obtain approval from the Arkansas Commission on Law Enforcement Standards and Training before creating a new law enforcement agency or reactivating an inactive agency.

Defines "inactive law enforcement agency" as a law enforcement agency that previously existed and operated under local ordinance but currently does not exist or has not operated for at least one year.

Requires presentation to the Commission of the ordinance and documentation covering funding mechanisms and sources, current budget proposal, proposed agency policies, administrative structure and organizational chart, and any other Commission-required information.

Mandates that proposed law enforcement agency policies must address use of force, vehicle pursuit, professional conduct of officers, and bias-based policing.

Grants the Commission authority to approve or disapprove requests for creation or reactivation of law enforcement agencies following the required presentation.
