Creates a new "exempt facility" category for residential care facilities housing fewer than 10 individuals with impaired functional capabilities who do not require hospital or nursing home care on a daily basis

Exempt facilities must meet four conditions: (A) individual or power of attorney contracts for services, (B) facility does not bill Medicare, Medicaid, or insurance companies, (C) facility does not provide nursing home or skilled nursing care except through third-party providers like hospice or home health agencies, and (D) facility registers with Department of Human Services and consents to annual inspections

Excludes exempt facilities from the definition of "residential care facility" under Arkansas Code § 20-10-101(15)

Excludes exempt facilities from the definition of "assisted living facility" under the Arkansas Assisted Living Act § 20-10-1703(1)
