Amends Arkansas Code § 5-14-126 to clarify that sexual assault in the third degree includes conduct by those in positions of trust or authority who engage in sexual intercourse or deviate sexual activity with custodial victims.

Expands the definition to include mandated reporters under § 12-18-402(b) and members of the clergy who use their position of trust or authority to engage in sexual conduct with victims.

Maintains that persons employed with or contracted to provide services to agencies maintaining custody of inmates, detainees, or juveniles who engage in such conduct are subject to prosecution.

Establishes a 3-year age gap affirmative defense for minors charged under the statute when the victim is less than 14 years old.

Classifies sexual assault in the third degree as a Class C felony, with victim consent being no defense to prosecution.
