AR HB1756

Amends Arkansas Code § 5-71-213 to clarify and expand the definition of loitering offenses, including lingering in public places without apparent reason, near school buildings without authorization, or while begging in a harassing manner.

Specifies that loitering includes lingering for purposes of unlawful gambling, prostitution, controlled substance use/distribution, or unlawful alcohol consumption.

Adds circumstance that a person may be considered loitering if they have acted in a harassing or threatening manner or in a way likely to cause alarm after sunset or before sunrise.

Provides defense to prosecution if law enforcement officer failed to afford defendant opportunity to identify themselves and explain their presence, or if defendant's explanation was true and would have dispelled the alarm.

Classifies loitering as a Class C misdemeanor.
